1. Introduction
These Terms and Conditions ("Terms") govern your use of the Qualify Nation platform and services provided by Group Everest Limited (trading as Qualify Nation), a company registered in England and Wales.

2. Eligibility Requirements
- You must be at least 16 years old to use our services
- Each individual may have only one personal account (no sharing)
- You must provide accurate information during registration
- No formal educational prerequisites are required
- You need access to a computer/laptop with stable internet connection
3. Course Access and Licensing
3.1 License Grant
Upon purchase, you receive a limited, non-exclusive, non-transferable license to access course materials for personal educational purposes only.
3.2 License Duration
Your license is valid for one year from the date of purchase. Access does not automatically renew and requires renewal after expiration.
3.3 License Revocation
Your license is conditional upon compliance with these Terms. Violations may result in immediate termination of access without refund.
4. Payment Terms
4.1 Pricing and Commitment
- All courses are paid products with pricing locked at the point of purchase
- Your purchase represents a fixed-term commitment for the full licence period (typically one year). This is not a rolling monthly subscription and cannot be cancelled on a month-to-month basis.
- Instalment plans spread the cost over time for convenience but do not change the nature of the commitment — all payments remain due in full regardless of whether you complete, pause, or stop engaging with the course
- Taxes are additional unless explicitly stated otherwise
- Payments are processed securely through Stripe
4.2 Payment Plan Default
If you are on an instalment plan and fail to make a scheduled payment:
- First missed payment: You will receive a reminder notification. Access to your course continues while the payment is outstanding.
- 14 days overdue: Your course access will be suspended until the outstanding payment is made. Your progress and data are preserved.
- 30 days overdue: Your account may be escalated for debt recovery. The full remaining balance of your course fees becomes immediately due.
- Any Job Guarantee (where applicable) is suspended during payment default and will not resume until all outstanding payments are cleared
- Stopping a direct debit, cancelling a payment card, or otherwise deliberately avoiding scheduled payments does not cancel your course or release you from the payment obligation
4.3 Price Match Guarantee
We offer a like-for-like price match guarantee within 30 days of purchase. If you find the same course offered by a competing provider at a lower price, we will match it, subject to the following conditions:
- The competing course must be substantially equivalent in content, duration, certification outcome, and level to the Qualify Nation course you purchased
- The lower price must be publicly available and currently advertised at the time of your claim — it cannot be a members-only rate, employer-sponsored price, cashback offer, or price available only through a voucher, coupon, or promotional code
- The competing provider must be a legitimate, established training provider offering the course commercially to the general public
- You must submit your price match request within 30 days of your original purchase date by raising a support ticket through the platform, including a link to or screenshot of the competing offer
- If your claim is approved, we will adjust your remaining payments or issue a partial refund of the difference to your original payment method. The adjustment applies to the price difference only — it does not entitle you to a full refund or cancellation
- Qualify Nation reserves the right to verify the competing offer and to determine, at its sole discretion, whether the course qualifies as a like-for-like equivalent
- The price match guarantee applies to individual consumer purchases only and is not available for institutional, group, or business enrolments
- Only one price match claim may be made per course purchase
5. Refund Policy
5.1 Statutory Cooling-Off Period
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, UK consumers purchasing online have a 14-day right to cancel from the date of purchase. However, our courses constitute digital content. During the checkout process, you are asked to:
- Provide your explicit consent to begin accessing course materials immediately
- Acknowledge that by accessing digital content, you lose your right to cancel under the 14-day cooling-off period
If you have not accessed any course materials (no login, no content viewed), you retain the right to cancel within 14 days of purchase for a full refund.
5.2 Refund Eligibility
Outside the statutory cooling-off period, refunds are available only under extremely limited circumstances:
All of the following must be met:
- No account login or course material access has occurred
- Request is submitted within 14 days of purchase
- Buyer is an individual consumer (not a business or institutional purchaser)
5.3 Refund Disqualifying Factors
You are not eligible for a refund if any of the following apply:
- You have logged into your account and accessed any course material, however briefly
- Your request is submitted after the 14-day window
- Your account has been terminated for academic misconduct or breach of these Terms
- You simply changed your mind about studying, lost motivation, or found the course more difficult than expected
- You are dissatisfied with the pace, format, or style of the course (these are described before purchase)

6. Cancellation and Early Withdrawal
6.1 Can I Cancel My Course?
We understand that circumstances change. However, your course purchase is a fixed-term licence commitment, not a rolling subscription. There is no mechanism to cancel a course mid-way through and stop future payments. This is because:
- Your course fee covers the full licence period, including access to all materials, labs, examinations, and career support
- Instalment plans are a payment convenience, not a pay-as-you-go arrangement — they divide the total cost into smaller amounts but do not make each payment optional
- Course resources, infrastructure, and support are provisioned for the full licence period at the point of your enrolment
6.2 What Happens If I Stop Studying
You are free to stop engaging with your course at any time. However:
- Payment obligations continue. All scheduled payments remain due in full regardless of whether you continue studying. Stopping payments without authorisation is a breach of these Terms (see Section 4.2).
- Your access remains open. Your course materials, progress, and lab environments remain available for the duration of your licence period. You can resume at any time.
- No refund applies. Choosing to stop studying does not entitle you to a full or partial refund of fees already paid or fees remaining on your payment plan.
- Certificates are not issued until all course requirements are met and all payments are up to date.
6.3 Exceptional Circumstances
We recognise that genuinely exceptional circumstances can arise (such as serious illness, bereavement, or other events beyond your control) that may prevent you from continuing your studies. In such cases:
- Contact us through the platform’s support ticket system to explain your situation
- We will consider requests for a licence pause (suspending your access and extending your licence period by the paused duration) on a case-by-case basis
- We may, at our sole discretion, offer alternative arrangements such as a course transfer or extended access
- Exceptional circumstance requests must be supported by reasonable evidence (e.g., a medical certificate, death certificate, or other documentation)
- Exceptional circumstances do not automatically entitle you to a refund, but we will seek a fair resolution
6.4 Your Rights Under UK Consumer Law
Nothing in this section affects your statutory rights under UK consumer law. If you believe the service provided is not as described, not fit for purpose, or not delivered with reasonable care and skill, you may have additional rights under the Consumer Rights Act 2015. We encourage you to raise any concerns through our support ticket system so we can resolve them promptly.
7. Intellectual Property Rights
- All course content is owned by Qualify Nation or our licensors
- Students receive a usage license, not ownership of content
- Prohibited: copying, publishing, sharing, reverse-engineering, or redistributing any materials
- Downloadable resources are for personal use only
- Certificates are non-transferable and do not constitute academic degrees
8. User Conduct, Academic Integrity & Ethical Obligations
8.1 Your Ethical Commitment
Qualify Nation® certificates represent genuine, verified competency. By enrolling in any course, you accept a personal responsibility to engage honestly and ethically with the learning process. The purpose of our programmes is to develop real skills and knowledge — not merely to obtain a certificate. A certificate earned through dishonest means is worthless to you, misleading to employers, and unfair to every student who earned theirs legitimately.
You acknowledge that:
- The value of your certificate depends entirely on it reflecting genuine competency
- Employers and institutions rely on the integrity of our certification process when making hiring and progression decisions
- You have a duty to engage authentically with all learning materials, assessments, labs, and examinations
- Attempting to obtain a certificate without genuinely acquiring the underlying skills defeats the purpose of your enrolment and violates these Terms
8.2 Prohibited Conduct
The following behaviours constitute academic misconduct and are strictly prohibited:
- Cheating in assessments or examinations: Using unauthorised materials, notes, devices, or aids during quizzes, assessments, or proctored examinations
- Impersonation and identity fraud: Having another person complete coursework, labs, or examinations on your behalf, or completing them on behalf of another student
- AI-assisted dishonesty: Using artificial intelligence tools (including but not limited to ChatGPT, Claude, Copilot, or similar) to generate or substantially complete assessment answers, lab submissions, or examination responses, unless the assessment explicitly permits AI use
- Plagiarism: Submitting work that is not your own, including copying from other students, external sources, or AI-generated content, without proper attribution where permitted
- Sharing assessment content: Distributing, publishing, or sharing examination questions, assessment answers, lab solutions, or any other assessment materials with others, whether publicly or privately
- Circumventing proctoring: Attempting to bypass, disable, or interfere with proctoring software, monitoring tools, or examination security measures in any way
- Unauthorised collaboration: Working with others on assessments or examinations that are designated as individual work
- Fabrication of evidence: Falsifying lab results, portfolio work, or practical exercise outcomes
- Multiple accounts: Creating or using more than one account to circumvent assessment rules, retake limits, or access restrictions
8.3 General Platform Conduct
In addition to academic integrity obligations, you agree to:
- Use the platform only for lawful purposes
- Maintain only one personal account and not impersonate others
- Not share your login credentials with any other person
- Treat fellow students, staff, and support agents with respect
- Not attempt to gain unauthorised access to any part of the platform, other users' accounts, or our systems
- Not use automated tools, bots, or scripts to interact with the platform unless expressly authorised
8.4 Monitoring and Detection
Qualify Nation employs a range of measures to detect and prevent academic misconduct, including but not limited to:
- AI-powered proctoring during examinations, including identity verification, environment monitoring, and behavioural analysis
- Plagiarism and similarity detection across submissions
- Behavioural analytics to identify patterns inconsistent with genuine learning (such as completing advanced assessments without engaging with course materials)
- Audit logging of platform activity
By using our platform, you consent to these monitoring measures as a necessary part of maintaining the integrity and value of our certification process.
8.5 Consequences of Academic Misconduct
Violations of this section may result in one or more of the following actions, at Qualify Nation's sole discretion:
- Warning: A formal written warning for minor or first-time infractions
- Assessment invalidation: Nullification of specific assessment or examination results, with or without the opportunity to retake
- Certificate revocation: Withdrawal of any certificate(s) already issued, including notification to any institution or employer that verified the certificate through our systems
- Immediate account termination: Permanent loss of access to all courses, materials, and platform features without refund
- Reporting: Where appropriate, misconduct may be reported to relevant professional bodies, employers, or educational institutions
Academic misconduct constitutes a material breach of these Terms. Serious or repeated violations will result in immediate termination of access without refund.
9. Sandbox Environment
Our sandbox environments are for educational use only:
- User-created content remains your property
- Qualify Nation retains a license to host and display content for service purposes
- Content may be deleted after access expiration
- Sandboxes are not intended for public internet deployment
10. Termination of Access
Access may be terminated:
- Automatically: Upon one-year license expiration
- Voluntarily: Through student-initiated account deletion
- For Violations: Immediately at company discretion
Effect of termination: Loss of all course access, user content may be deleted, no refund applies.
11. Recruitment & Career Services
11.1 Overview
Qualify Nation® may offer recruitment and career placement services to eligible students. These services are provided at no additional cost to the student. Qualify Nation acts solely as an introducer between students and prospective employers — we are not an employer, and no employment relationship exists or is implied between Qualify Nation and any student as a result of these services.
Recruitment services may include:
- Matching qualified students with relevant job opportunities from our employer network
- Sharing your professional profile, CV, and qualification details with prospective employers (with your prior consent)
- Interview preparation, CV support, and career coaching through our Grow platform
- Facilitating introductions and coordinating interview scheduling
Not all students are eligible for recruitment services. Eligibility depends on course completion status, assessment results, and engagement with career development activities. Qualify Nation reserves the right to determine eligibility at its sole discretion.
11.2 Consent and Data Sharing with Employers
We will never share your personal data with a prospective employer without your explicit prior consent. Before any introduction is made, you will be informed of:
- The employer’s identity and the role in question
- The type of employment (permanent, contract, or temporary)
- The location, working arrangement (on-site, hybrid, or remote), and salary range where available
- What personal data will be shared (typically your name, contact details, CV, and relevant qualification/certification details)
You may decline any introduction without affecting your eligibility for future opportunities. You may withdraw from recruitment services entirely at any time by submitting a support ticket through the platform.
11.3 Employer Relationships and Fees
Qualify Nation may receive placement fees, referral fees, or other commercial compensation from employers for successful introductions. You will never be charged for recruitment services. The existence of a commercial relationship between Qualify Nation and an employer does not affect our obligation to act in your best interests when making introductions.
11.4 Job Guarantee
Qualify Nation may, at its sole discretion, offer a Job Guarantee to selected students. The Job Guarantee is not a standard feature of any course and is offered only where a separate, written Job Guarantee Agreement has been signed by both the student and Qualify Nation. If you have not signed a Job Guarantee Agreement, no job guarantee applies to your enrolment.
The terms, conditions, obligations, activation requirements, eligibility criteria, and remedies of the Job Guarantee are set out exclusively in the individual Job Guarantee Agreement. In the event of any conflict between these Terms and your Job Guarantee Agreement, the Job Guarantee Agreement prevails on matters relating to the guarantee.
11.5 Limitations of Recruitment Services
You acknowledge and agree that:
- Qualify Nation does not guarantee employment except where a signed Job Guarantee Agreement exists
- Qualify Nation is not responsible for the conduct, terms, working conditions, or decisions of any employer
- Any employment contract is solely between you and the employer — Qualify Nation is not a party to it
- Qualify Nation is not liable for dismissal, redundancy, or any dispute arising from your employment after placement
- Salary and benefits are determined by the employer, not by Qualify Nation (except to the extent that a minimum salary is specified in a Job Guarantee Agreement)
- Recruitment timelines are estimates, not commitments — the job market is influenced by factors outside our control
- Qualify Nation may use third-party recruitment partners to facilitate introductions, in which case the same data sharing consent requirements apply
12. AI-Powered Services
Our platform uses artificial intelligence to provide chat support, voice call agents, and learning assistance. By using these features, you acknowledge and agree to the following:
12.1 How AI Services Work
- AI-powered chat and voice agents are clearly identified as non-human
- Human escalation is available upon request
- AI responses are generated in real time and are offered “as-is” without guarantees of accuracy, completeness, or suitability
- You should independently verify any critical information provided by AI agents before acting on it
12.2 Third-Party AI Providers
To deliver AI-powered chat, voice, and learning assistance features, your inputs (including chat messages, voice transcriptions, and related context) are transmitted to third-party AI service providers for processing. These providers process your inputs to generate responses and may retain data in accordance with their own data processing agreements. We select providers that offer appropriate data protection commitments, but you should be aware that your inputs leave our infrastructure during processing. For details on how your data is handled, see our Privacy Policy. A full list of our current sub-processors is available upon request by submitting a support ticket through our platform.
Do not share sensitive personal information (such as financial details, passwords, government identification numbers, or health information) in conversations with AI agents. While we take reasonable measures to protect your data, information shared with AI services is processed by third-party systems outside our direct control.
12.3 Data Retention and Monitoring
- Conversation and call logs are stored on our managed infrastructure for service improvement, quality assurance, and support purposes
- Logs may be reviewed by authorised Qualify Nation staff
- We retain AI interaction data in accordance with our Privacy Policy
13. Official Support Channels
13.1 How to Get Support
All student support — including account queries, course-related questions, technical issues, payment matters, and complaints — is provided exclusively through our platform’s built-in support ticket system. This is the only channel through which Qualify Nation staff are authorised to access your account, discuss personal data, or resolve academic matters.
13.2 Social Media and Unofficial Channels
Qualify Nation staff are not authorised to handle student-specific queries via social media, personal messaging apps, email to personal addresses, or any channel outside the platform’s official support system. This includes but is not limited to Instagram, Facebook, X (Twitter), LinkedIn, WhatsApp, Telegram, and TikTok.
If you contact a staff member through social media or any unofficial channel regarding your account, coursework, grades, payments, or any matter involving personal data:
- The staff member will redirect you to the platform’s support ticket system and will not engage with the query on that channel
- Any personal data you share via social media or unofficial channels is shared at your own risk and is not covered by our data protection obligations under UK GDPR
- Qualify Nation accepts no responsibility for the security, confidentiality, or retention of information shared outside our official support system
- Responses or commitments made outside official channels (if any) are not binding on Qualify Nation
13.3 Why This Policy Exists
This policy exists to protect you. Our support ticket system provides a secure, auditable record of all interactions, ensures your personal data is handled in compliance with UK GDPR, and guarantees that your query is routed to the right team. Social media platforms are not designed for handling sensitive educational or personal data, and we cannot guarantee the confidentiality of information shared through them.
14. Disclaimers and Liability
- Services are provided "as is" without warranties
- No guaranteed results from course completion
- Content may contain errors or become outdated
- Our services do not constitute professional licensed advice
- We are not liable for third-party content or technical outages beyond reasonable control
15. 11+ Practice Tests Disclaimer
Qualify Nation provides 11+ practice tests as an unofficial preparation tool. By using the practice test feature, you acknowledge and agree that:
- Practice tests are created by Qualify Nation for preparation purposes only. They are not official exam papers and do not represent past, current, or future official 11+ examinations.
- Qualify Nation is not affiliated with, endorsed by, or connected to any official examining body, Kent County Council, any grammar school, any local authority, or any government education department.
- Questions are written to be representative of the style and difficulty of the 11+ exam, but may contain errors, inaccuracies, or differences from official exam content. We make reasonable efforts to ensure accuracy but do not warrant that all questions and answers are error-free.
- Performance on practice tests does not predict, indicate, or guarantee performance on any official examination. A child who scores highly on our practice tests may not achieve the same result on the official exam, and vice versa.
- Pass marks, timing, and test structures described on our platform are based on publicly available information and may not reflect the most current official requirements. Parents should verify current exam details with the relevant examining authority.
- Qualify Nation accepts no liability for any admission decisions, exam outcomes, school placements, or any other consequences arising from the use of our practice tests.
- Practice test content, scores, and analytics are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose.
- The practice test feature is provided free of charge. This does not create any obligation on Qualify Nation to maintain, update, or continue providing the service.
Parents and guardians are responsible for supplementing practice tests with other preparation methods as they see fit, and for making independent decisions about their child's education.
16. Liability Limitations
- No liability for indirect or consequential damages
- Direct damages capped at amount paid for course in preceding 12 months
- User assumes risk of harm from interactions with other users
17. Governing Law
These Terms are governed by the laws of England and Wales. Exclusive jurisdiction lies with the courts of England and Wales. Consumer protections under mandatory local law are preserved.
18. Changes to Terms
- We reserve the right to modify these Terms
- Material changes will be communicated with reasonable notice
- Continued use after effective date constitutes acceptance
- Minor changes may be effective immediately
19. Dispute Resolution
We encourage good faith informal resolution before legal action. Injunctive relief is reserved for intellectual property violations.
20. Apprenticeship Programmes
Qualify Nation® welcomes applications across a range of programme types, including self-paced professional qualifications, employer-sponsored training, and apprenticeship programmes where available.
Where a programme is delivered as an apprenticeship, the following additional terms apply:
20.1 Apprenticeship Agreement
Apprenticeship programmes require a formal agreement between the learner, the employer, and Qualify Nation® as the training provider. This agreement, together with a commitment statement signed by all three parties, governs the roles, responsibilities, and expectations of each party for the duration of the programme.
20.2 Employer Involvement
Apprenticeship programmes require the active participation of the learner’s employer. The employer must agree to support the learner’s off-the-job training during paid working hours, participate in regular progress reviews, and appoint a workplace mentor or supervisor. Qualify Nation® reserves the right to decline or defer an apprenticeship enrolment where the employer is unable or unwilling to meet these requirements.
20.3 Eligibility
Apprenticeship programmes are subject to eligibility criteria, including but not limited to the learner’s employment status, age, residency, and working location. Qualify Nation® will assess eligibility prior to enrolment and reserves the right to decline applications that do not meet the necessary criteria.
20.4 Funding
Where an apprenticeship programme is funded in whole or in part by government funding, delivery is subject to the applicable funding rules and conditions in force at the time. The learner will not be required to contribute financially to the cost of an apprenticeship programme. Any employer contribution will be set out in the contract for services between Qualify Nation® and the employer.
20.5 Duration and Completion
Apprenticeship programmes have a planned duration agreed at the outset. The programme may be extended, paused, or ended early in accordance with the applicable funding rules and the circumstances of the learner, employer, or provider. Changes to the planned duration will be agreed by all parties and documented in an updated training plan.
20.6 Withdrawal and Transfer
If a learner withdraws from an apprenticeship or their employment ends during the programme, Qualify Nation® will work with the learner, employer, and (where applicable) the relevant funding body to manage the process. Where possible, arrangements will be made to transfer the learner to an alternative employer or provider to minimise disruption.
